Beta Terms of Use

Important beta notice

OneStep Clinical Assistant is currently offered as a controlled beta. Some features are intentionally limited, disabled, or subject to change while the platform is refined. Providers remain responsible for reviewing and approving all clinical documentation before use.

1. Product and Legal Entity

These Terms of Use ("Terms") govern access to and use of OneStep Clinical Assistant, including the built-in OneStep Scribe documentation feature, clinical tools panel, templates, transcription workflows, and related services (collectively, the "Service"). The Service is operated by OneStep Scribe LLC ("we," "us," or "our").

By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Verified Beta Access

The Service is intended for licensed, credentialed, or supervised behavioral health professionals, including psychiatrists, psychiatric nurse practitioners, psychologists, therapists, counselors, social workers, trainees under supervision, and other authorized clinical documentation users.

During beta, accounts are created or activated after provider verification, which may include NPI verification, professional role review, and confirmation that the user is authorized to create or assist with clinical documentation.

By using the Service, you represent and warrant that:

You are a licensed, credentialed, or supervised healthcare professional, or you are otherwise authorized to document clinical encounters under applicable supervision.

You will not misrepresent your credentials, license status, NPI, clinical role, or authorization to use the Service.

You will not share account credentials or allow another person to use your account.

You will use the Service only for lawful documentation-support purposes.

3. Beta Access, Feature Limits, and Changes

Beta access is provided at no charge unless otherwise agreed in writing. We may limit, modify, suspend, or discontinue beta access or any beta feature at any time.

Certain fields and workflows are intentionally limited during beta. For example, date of birth entry may be disabled as part of a PHI-minimization approach. Features may change as we improve security, usability, and clinical documentation workflows.

Beta access does not guarantee future free access, future pricing, availability, or continued feature availability after beta.

4. PHI-Minimization During Beta

During beta, you agree to use a PHI-minimization approach whenever reasonably possible:

Avoid entering real patient names when possible. Use initials, aliases, or internal reference labels instead.

Do not enter patient date of birth if the field is disabled or not required for your workflow.

Avoid speaking or entering unnecessary identifiers during testing or troubleshooting.

Understand that transcripts and generated notes may still contain PHI if PHI is spoken or entered during the session.

You are responsible for reviewing, editing, exporting, storing, and using final documentation in accordance with your clinical, legal, organizational, payer, and licensing-board obligations.

5. Business Associate Agreement Before PHI Use

If you are using the Service in a HIPAA-covered capacity or intend to process Protected Health Information (PHI) through the Service, a Business Associate Agreement (BAA) must be executed before PHI is processed. Contact us at [email protected] to request a BAA.

Do not use the Service with PHI unless you have confirmed that the appropriate BAA and organizational approvals are in place.

6. Clinical Responsibility and AI Draft Disclaimer

The Service is a clinical documentation support tool. It does not replace clinical judgment, diagnosis, treatment decisions, safety assessment, emergency evaluation, or provider review.

AI-generated notes are drafts only and require clinician review and approval before use.

You are solely responsible for the accuracy, completeness, clinical appropriateness, billing support, and finalization of documentation.

The Service does not prescribe medications, make treatment decisions, provide medical advice, or independently diagnose patients.

You must comply with your licensing board requirements, organizational policies, documentation standards, payer requirements, and applicable law.

7. No Emergency or Crisis Use

The Service is not intended for emergencies, crisis intervention, suicide-risk monitoring, violent-risk monitoring, real-time safety alerts, or time-sensitive clinical decision-making. If a patient may be at imminent risk, use your standard emergency, crisis, and safety protocols.

8. Audio, Transcripts, Notes, and Metadata

Session audio is processed for transcription and is not retained by OneStep Clinical Assistant after transcription. If any temporary audio artifact is created during processing, testing, or troubleshooting, it must be deleted the same day.

Generated transcripts, notes, alerts, templates, and annotations may be stored to support your workflow. Session metadata may be logged for security, troubleshooting, audit, and platform integrity purposes.

Patient data, transcripts, and notes are not used to train AI models.

9. Acceptable Use

You agree not to:

Use the Service for unlawful purposes or outside your clinical authorization.

Use generated documentation without review and approval.

Attempt to reverse engineer, copy, scrape, overload, or disrupt the Service.

Upload malicious code or attempt unauthorized access to systems or data.

Use the Service to document encounters you did not conduct, supervise, or otherwise have authority to document.

Use the Service in a way that violates patient privacy, HIPAA obligations, organizational policies, or payer rules.

10. Data Ownership, Export, and Deletion

You retain ownership of clinical documentation you create using the Service. We do not claim ownership of your clinical content. You may request export or deletion of your account data by contacting us. Some deletion timelines may depend on security, backup, legal, or operational requirements described in the Privacy Policy and applicable agreements.

11. Intellectual Property

The Service, including its design, workflows, prompts, templates, tools, branding, and underlying technology, is owned by OneStep Scribe LLC and protected by applicable intellectual property laws. You receive a limited, non-transferable right to use the Service for its intended documentation-support purpose.

12. Suspension and Termination

We may suspend or terminate access if we reasonably believe your use violates these Terms, creates security risk, creates privacy risk, misrepresents credentials, or threatens platform integrity. You may stop using the Service at any time and request account deletion.

13. Limitation of Liability

To the fullest extent permitted by law, OneStep Scribe LLC is not liable for indirect, incidental, special, consequential, punitive, clinical, billing, reimbursement, documentation, or business-interruption damages arising from use of the Service. The Service is provided as beta documentation support and must be reviewed by the provider before use.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes shall be handled in courts located in New Jersey unless otherwise required by law.

15. Changes to These Terms

We may update these Terms from time to time. We will update the effective date and provide notice of material changes when appropriate. Continued use after changes take effect means you accept the updated Terms.
